1. Scope of Policy
- This Policy applies to all purchases of services and products offered by Gengenius Studios LLC (“Company,” “we,” “our,” or “us”) through our website or directly with our team.
- Because our services are custom-made and individually manufactured, standard retail return practices do not apply.
2. No Returns on Custom Services
- All services involving custom pattern-making, sampling, cut & sew production, and made-to-order manufacturing are non-returnable.
- Custom services are specifically tailored to client specifications and cannot be resold.
3. Refund Eligibility
Refunds may only be considered in the following limited circumstances:
A. Cancellation Before Production
- If a client cancels a production order before any stitching, cutting, or sampling work begins, a partial refund of payments made may be issued.
- Non-refundable fees (e.g., design work, pre-production sampling) will be retained.
B. Defective Items
- If physical goods delivered contain material defects or manufacturing errors not caused by client-supplied materials or specifications, you may be eligible for a repair, replacement, or refund.
4. Defect Reporting Requirements
To be considered for a remedy under Defective Items:
- You must notify us in writing within 5 business days of receipt.
- You must provide:
- Clear photos of the item(s)
- A detailed description of the issue
- Proof of purchase or order confirmation
- We may request that defective items be returned or made available for inspection.
5. Evaluation and Resolution
- Upon receipt of defect notification, we will evaluate the claim within 10 business days.
- If a defect is confirmed and determined to be our responsibility:
- We may offer repair, replacement, or partial refund at our discretion.
- If we determine no defect exists or the issue arises from client-supplied materials/specifications:
- No refund or replacement will be issued.
6. Partial Refunds
- Any refund granted will be calculated based on the value of the defective item or unused portion of services.
- Refunds will be issued via the original method of payment, unless otherwise agreed.
- Processing time for refunds may take up to 14 business days after approval.
7. Shipping Costs
- Shipping and handling fees are non-refundable, except when the return is a result of our error.
- If a return shipment is required due to a defect we acknowledge, we will provide or reimburse reasonable return shipping costs.
8. Cancellation and Change Fees
- Order cancellations after sampling has begun will result in forfeiture of any non-refundable deposits.
- Changes requested by the client after final approval may incur additional charges and do not entitle the client to a refund on previously completed services.
9. Exceptions & Special Circumstances
- Any exceptions to this policy must be approved in writing by Gengenius Studios LLC.
- This policy does not supersede contractual terms in separately executed agreements unless specified.
10. No Implied Warranties
- Except where prohibited by law, we disclaim all implied warranties, including merchantability or fitness for a particular purpose on custom services.
11. Governing Law
- This Return & Refund Policy is governed by the laws of the State of New York.
- Any disputes arising from this Policy shall be resolved in New York jurisdiction.
